Marketplace terms

R35 is a software and technology platform that lets independent real-estate investors ("wholesalers") publish their own listings and lets visitors find them. R35 is not a real-estate broker, agent, salesperson, dealer, lender, mortgage broker, auctioneer, escrow or closing agent, appraiser, inspector or title company, and is not a party to any transaction between a visitor and a wholesaler. R35 does not own, sell, list, market, verify, inspect, appraise or guarantee any property, price, description, photo or other content, and no fiduciary, agency or advisory relationship arises between R35 and you.

Every listing is created and controlled by the wholesaler who posted it. A wholesaler may be marketing their contract right or equitable interest in a property rather than holding title to it. The wholesaler alone is responsible for the accuracy, completeness and legality of a listing, including any disclosures, licences or registrations that state or local law requires for wholesaling, assigning contracts or marketing an equitable interest, and for any agreement they make with you. Prices, status and availability can change or be wrong.

Lot lines, owner names, acreage, zoning, flood zones, schools, places, area figures and similar information come from public records and third parties (such as county GIS services, the U.S. Census Bureau, FEMA, the EPA, NCES, OpenStreetMap contributors and Esri) — see Data sources. It is provided as-is, may be incomplete, outdated or inaccurate, and is not a survey, title report, appraisal, inspection, flood determination or legal description.

When you send an inquiry or showing request, it goes to the wholesaler who posted the listing, not to R35, and you agree that the wholesaler may contact you about the property and similar deals by phone, text or email, including by automated means. Consent is not a condition of any purchase. If you ticked "Send me similar deals", the wholesaler may send you other listings; you can opt out at any time by telling the wholesaler, or by replying STOP to a text. R35 is not responsible for a wholesaler's communications or conduct.

Before you rely on any listing or data, or enter into any agreement, do your own due diligence and consult licensed professionals — for example an attorney, title company, surveyor, inspector, appraiser, lender or real-estate licensee — as appropriate.

The marketplace and all listings and data are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, title and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, R35 and its officers, employees and suppliers are not liable for any loss or damage arising from any listing, any public-record or third-party data, any communication or transaction with a wholesaler, or your use of the marketplace, and the limitations of liability, indemnity, governing-law and dispute terms of the Terms of Use apply.
